1. Acceptance of Terms
By accessing or using Gear2Peer, you agree to be bound by these Terms & Conditions, our Privacy Policy, and any other rules or guidelines we post.
2. Platform Purpose
Gear2Peer is a peer-to-peer rental marketplace for outdoor gear. We do not own or inspect the equipment listed. All rentals are arranged directly between users.
3. User Responsibilities
- Users must provide accurate information and respect rental agreements.
- Users are responsible for ensuring the safety and proper function of gear they lend or rent.
- You agree to use all gear in accordance with applicable safety standards and local laws, and accepted best practices.
4. Pickup & Drop-Off
All rentals are pickup and drop-off only — no shipping is currently offered.
Users are expected to coordinate logistics respectfully and on time.
5. Payments & Fees
All payments are made through our platform. Gear2Peer takes a commission from both renters and lenders, which will be disclosed before any transaction is completed. We are working on keeping costs as low as possible, however, we are responsible for costs such as payment processing charges from Stripe, and hosting our website, etc.
6. Cancellations & Refunds
Cancellation and refund policies will vary by listing. We recommend clear communication between users. If disputes arise, Gear2Peer reserves the right to mediate but is not liable for any damages or losses.
7. Damage & Disputes
Users are responsible for returning gear in the condition it was rented. In case of damage, loss, or theft, we encourage direct resolution between parties. Gear2Peer may step in to mediate, but is not an insurer or guarantor.
8. Platform Changes
We may update these terms at any time. Continued use of the platform means you accept the new terms.
9. Liability
Gear2Peer is not liable any for injury, damage, or loss resulting from the use of any rented gear or the use of the Gear2Peer platform. Use common sense, inspect gear carefully, and know your limits. Users accept personal responsibility for their own safety and liability while using the Gear2Peer platform.
10. Indemnification
In addition to and without limiting the scope of the indemnification obligations set out in the terms and policies above:
- You agree to indemnify and hold us harmless from and against any claims (including but not limited to claims for property damage, bodily injury or death, and to the extent permitted by law, claims based on our negligence), damages, losses and expenses of any kind (including reasonable legal fees and costs) (collectively, "Claims”) arising from or related to your sale/rental/lending of products using our Features, the products you sell, rent, or lend using our Features, your acts or omissions with respect to User Data or any breach or alleged breach of these Terms.
- You agree to indemnify and hold us harmless from all Claims related to Taxes & Fees, including any penalties and interest ("Tax Liabilities”) that may result from your use of Gear2Peer Features. You agree that (a) we have no liability to you or any taxing jurisdiction for any Tax Liabilities; (b) you are solely responsible and liable for payment of Tax Liabilities; and (c) you shall not seek reimbursement from us for Tax Liabilities.
